THE HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.33475 of 2014 ORDER:

There is no representation on behalf of the petitioner. 2.

The prayer sought in the writ petition is as under:- "...to issue an appropriate Writ, Order, Direction more particularly one the nature of Writ of Mandamus declaring the action of the respondents in interfering with the construction activities of the petitioner in Plot No.22 admeasuring 310 sq.yards, in Sy.No.9/1/F, situated at Saroornagar Village and Revenue Mandal, Ranga Reddy District as illegal, arbitrary, without jurisdiction, unreasonable, violative of Articles 21 and 300-A of the Constitution of India and to pass such other order or orders as this Hon'ble Court deems fit and proper in the circumstances of the case."

Learned Government Pleader appearing for the respondents 1 to 3 placed on record the written instructions issued by the 3rd respondent-Station House Officer, L.B.Nagar Police Station, Ranga Reddy District.

From a perusal of the said written instructions, it is revealed that as per the records, one Mr.V.Venkat Reddy, General Power Attorney of Geetha Bhavani, approached the 4th respondent on 30.10.2014 and lodged a complaint stating that they have obtained injunction orders from the District Court, Warangal, in a family dispute between four brothers and their sister Geetha Bhavani. Hence requested the police to prevent culprits from indulging illegal constructions. After receipt of the same, an entry was made in the General Diary of the Station on 30.10.2014. Thereafter, the respondent police advised the complainant to seek redressal in a competent civil Court. Therefore, no action of whatsoever has been

taken. On coming to know about lodging of the complaint by Mr.Venkat Reddy, the petitioner herein rushed to this Court and filed the present writ petition with all false and baseless allegations. It is further mentioned in the instructions that as on the date of issuance of the written instructions, no case of whatsoever was registered against the petitioner on the file of the L.B.Nagar Police Station. It is also specifically stated that the respondent police never interfered with the civil disputes, much less any disputes of the petitioner. The 3rd respondent never interfered with the peaceful possession and enjoyment of the subject property of the petitioner in question. However, as a precautionary measure to prevent the police from taking any action in the event of lodging of any complaint against the petitioner, the present writ petition is filed with false and baseless allegations.

In that view of the matter, this Court is of the opinion that there are no merits in the writ petition and the same is liable to be dismissed.

Accordingly, the writ petition is dismissed. No order as to costs.
