Janga Sudhakara Rao v. The State Of Andhra Pradesh,
HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.39227 of 2015 ORDER:
Heard.
The grievance of the petitioners is with regard to not referring the Award to the Civil Court under Section 18(1) of the Land Acquisition Act. However, on examination of the record shows that the award itself was passed on 21-05-2015, as is evident from 12(2) notice issued to the claimants including the petitioners. The petitioners' request seeking compensation in the shape of claim objections statement, copy of which is filed as Ex.P-8, dated 28-04-2015, is prior to passing of the award. Hence, no reference could be made on the basis of that claim. If law permits, the petitioners are at liberty to make appropriate application seeking reference. However, no relief can be granted in the writ petition.
Hence, the writ petition is dismissed. No order as to costs. Miscellaneous petitions, if any, pending shall stand closed. _______________________ VILAS V.AFZULPURKAR, J Date: 07-12-2015 Prv
