ORDER:
This contempt case is filed alleging wilful disobedience of order dt.31.12.2013, in W.P. No.38854 of 2013, wherein this Court has directed respondent No.2 to ensure that the pattas stated to have been prepared by respondent No.1 are distributed to the petitioners within one month from the date of receipt of the order. In the counter affidavit filed by respondent No.2 it is inter alia stated that Land Possession Certificates (LPCs)/house site pattas were granted in favour of ten persons much prior to disposal of the writ petition, that house site pattas to the remaining persons could not be considered immediately in view of Memo No.44216 AssignmentI(1)/2011-1, dt.18.6.
2012 issued by the Government in respect of Visakhapatnam Urban Mandal, not to grant house site pattas within five kilometers from the Mandal Head Quarters and that with a view to implement the order of this Court the issue was again considered and LPCs to the remaining three persons were granted on 10.7.2015. While pleading that the delay in implementing the order of this Court is neither wilful nor wanton, respondent No.2 has tendered unconditional apology for the delay.
No rejoinder is filed controverting the above contents of the counter affidavit.
Having regard to the fact that the house site pattas were granted to all the petitioners herein, the order under contempt stands complied with.
