ORDER:
This petition is filed under Section 24 of the Code of Civil Procedure, 1908 to withdraw A.S No.247 of 2012 from the file of II Additional District Judge, Vijayawada, and transfer the same to this Court to try along with A.S No.850 of 2012.
Heard both sides.
A perusal of the record clearly reveals that the trial Court disposed of O.S.Nos.1073 of 2009 and 1143 of 2010 on 29.06.2012 by passing common judgment. Challenging the judgment and decree, dated 29.06.2012, in O.S No.1073 of 2009 passed by III Additional Senior Civil Judge, Vijayawada, petitioner filed A.S No.247 of 2012 on the file of II Additional District Judge, Vijayawada on the point of pecuniary jurisdiction.
Both the counsel in one voice submitted that as the subject matter involved in both the appeals is one and the same, A.S No.247 of 2012 may be withdrawn from the file of II Additional District Judge, Vijayawada and transfer the same to this Court to try along with A.S No.850 of 2012.
In view of submission made by both the counsel, the Transfer Civil Miscellaneous Petition is allowed. A.S No.247 of 2012 is withdrawn from the file of II Additional District Judge, Vijayawada and transferred the same to this Court to try along with A.S No.850 of 2012. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this petition shall stand closed.
