THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.3552 OF 2016

O R D E R

The prayer of the petitioner in this case is as under: 'Hon'ble Court may be pleased to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents 2 to 4 by threatening the petitioner to book a false case against the petitioner at the instance of respondents 5 and 6, is illegal, improper and violation of Articles 14, 19 and 21 of the Constitution of India and consequently direct the respondents 2 to 4 not to register any false cases against the petitioner and his family members at the instance of respondents 5 and 6 and pass such other order or orders as this Hon'ble Court may deem fit and proper in the interest of Justice.'

The Sub-Inspector of Police, Tenali I Town Police Station, Guntur Rural District, furnished written instructions dated 12.02.2016 to the office of the learned Government Pleader for Home, wherein he stated that upon the complaint made by respondents 5 and 6 against the petitioner, an entry was made in the General Diary and the Station House Officer, Tenali I Town Police Station, called the petitioner as well as respondents 5 and 6 for the purpose of enquiry. However, the petitioner did not approach the police authorities, but no FIR was registered against him. According to the Sub-Inspector, the petitioner was thereafter not even called to the police station. The allegation of the petitioner that the police authorities were trying to book false cases against him was denied. The Sub-Inspector stated that the police authorities were only discharging their duties and never interfered with the life and liberty of the petitioner or his family members at any point of time.

In the light of the afore-stated stand of the police authorities, which is duly taken on record, no adjudication is warranted on merits. Sri C.Masthan Naidu, learned counsel for the petitioner, is also agreeable to the closure of the case recording the said stand of the police authorities.

The writ petition is accordingly closed. Pending miscellaneous petitions shall also stand closed in the light of this final order. No order as to costs.
