THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.39261 of 2015 ORDER:

The grievance of the petitioner is that the police authorities are not taking necessary action on her complaint dated 06.10.2015 despite the fact that she is supported by a permanent injunction granted by the learned Principal Junior Civil Judge, Yellamanchali, in O.S.No.181 of 2008.

Perusal of the complaint dated 06.10.2015 reflects that it is bereft of reasons and no mention is made therein of the permanent injunction decree granted to the petitioner.

In that view of the matter, the writ petition is closed leaving it open to the petitioner to make a fresh complaint setting out all necessary facts and duly supported by the required documentation. In the event such a complaint is made to the police authorities, necessary action shall be taken thereupon in accordance with the law laid down by the Supreme Court, speaking through a Constitution Bench, in LALITA KUMARI V/s. GOVERNMENT OF UTTAR PRADESH. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
