HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.1180 OF 2018 ORDER:

This writ petition is filed questioning the auction dated 19.12.2017 conducted by respondents 3 and 4 with respect to fishing rights in Nalla Cheruvu and Erra Cheruvu situated at Thangellamudi Village, Peda Kakani Mandal, Guntur District, for the year 2017-18.

The auction is said to be over as far back as on 19.12.2017 and the writ petition came to be filed on 05.01.2018. As on date, except stating that the petitioner society representation for continuing them to catch fish for one more year was not accepted, no legal and valid grounds have been raised in the writ petition, warranting interference of this Court, about the auction conducted by the Gram Panchayat.

Though the petitioner, at this stage, submits that it is ready to offer better price than what has been quoted by the 5th respondent, the same cannot be a ground for setting aside the auction proceedings, inasmuch as, the petitioner itself had an opportunity to participate in the auction and it could have made an offer in the auction. Having not done so, the petitioner cannot take advantage of the inaction on their part and defeat the right of the 5th respondent in the auction.

Hence, I see no merit in the writ petition and accordingly, the same is dismissed.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed as a consequence. There shall be no order as to costs.
