Aggrieved by the action of the 2nd respondent - Assistant Director of Mines and Geology, Siddipet, Medak District, in issuing registration certificate to the Brick Kiln of the 7th respondent vide Registration No.07/BKRC/SDPT/2018-19 dated 25.04.2019, the present writ petition is filed. Learned counsel appearing for the unofficial respondent No.7 submits that the registration certificate issued to the unofficial respondent No.7 expired on 31.03.2019 and hence writ petition is not maintainable. Learned counsel for the petitioner submits that though the registration expired, the unofficial respondent No.7 is carrying on the activity. The same is disputed by the counsel for the unofficial respondent No.7. Since, the registration expired on 31.03.2019, it goes without saying that the respondent No.2 shall not permit the unofficial respondent No.7 from carrying on the activity of manufacturing of bricks.
The writ petition is accordingly disposed of. However, this order will not preclude the unofficial respondent No.7 from making application for renewal of licence, and before considering the same, the 2nd respondent / competent authority, shall issue notice to the petitioner, and after considering his objections, take appropriate decision in accordance with law within a period of six weeks from the date of making such application. Interlocutory applications pending, if any, shall stand closed. No order as to costs.
