This petition is filed seeking for quash of the proceedings against the petitioners, who are A.1 & A.2 in Crime No.196 of 2011 on the file of Narayanaguda Police Station, Hyderabad. 2.

Heard the learned counsel for the petitioners and learned Public Prosecutor for first respondent. None appears for the second respondent, in spite of notice.

A perusal of the complaint would show that the petitioners herein demolished the ancient temple with an intention to create religious conflict. The counsel for the petitioners submits that the temple is very much in existence as on today. The learned Public Prosecutor, on instructions, reports that the temple is very much in existence and intact. In view of the above, this Court is of the view that continuing further proceedings against the petitioners would result in abuse of process of law and the same is liable to be quashed.

Accordingly, the Criminal Petition is allowed and the proceedings in Crime No.196 of on the file of Narayanaguda Police Station, Hyderabad are quashed. As a sequel, the miscellaneous applications, if any pending, shall stand closed.
