HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.2060 of 2017 ORDER:

The case of the petitioner is that the appeal filed by the petitioner before the 3rd respondent was allowed by order dated 10-08-2016 vide proceedings in D.Dis.232/2007(B) and remanded the matter back to the 4th respondent. But no action has been taken. Aggrieved by the same, the present writ petition is filed.

Learned counsel for the petitioner submits that in pursuance to the remand order the matter is remanded back to the 4th respondent. But, no action has been taken by him.

It is also stated that since the matter is remanded back to the 4th respondent, the 4th respondent also issued notice dated 26-08-2016 to the parties. As such, it is obligatory on the part of the 4th respondent to consider the same and pass orders after issuing notice to the affected parties.

In view of the same, the 4th respondent is directed to take action in pursuance to the remanded order dated 10-08-2016 passed by the 3rd respondent within a period of eight weeks from the date of receipt of a copy of this order.

With the above direction, this writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 23-01-2017 Nvl
