THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.1168 of 2019 ORDER:
The prayer of the petitioners in this case reads as under: 'For the reasons stated in the accompanying affidavit, the petitioner prays that this Hon'ble Court may be pleased to issue an appropriate writ, direction or order, more particularly one in the nature of Writ of Mandamus, declaring the action of the respondent authorities, particularly respondent Nos.4 to 7 in not rejecting the 8th respondent nomination by considering the petitioner's objection petition and appeal petition dt. 14-01-2019 as illegal, arbitrary against the principle of natural justice and in contrary to the Panchayat Raj Election Rules and Act 2018 and consequently direct the respondent Nos.2 to 7 to eliminate the 8th respondent from contesting the post of Sarpanch of Juvvadi Village Gramapanchyat, Election to be held on 25-01-2019, Gandari Mandal, Kamareddy District by considering the petitioners objection petition and appeal petition on 14-01-2019 and to pass such other further order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case.'
The list of contesting candidates published in Form - IX by the Returning Officer does not even reflect the name of the eighth respondent and the question of eliminating his candidature in the ensuing election does not arise.
Ms.T.Rajya Lakshmi, learned counsel for the petitioners, would contend that the husband of the first petitioner, viz., China Sailu Koninti, is shown in the said list though he never filed a nomination and is not even in India. However, no grievance is ventilated in the context of the candidature of China Sailu Koninti in the writ prayer.
The writ petition is therefore utterly misconceived and is accordingly dismissed.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
