THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.13517 of 2004 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the action of the first respondent in directing the petitioner to retire from service on attaining the age of 58 years on 31.07.2004 without taking into consideration the resolution adopted in the 29th General Body Meeting held on 22.07.2004 and which was forwarded to the 2nd respondent for registering the amendments through the letter of the first respondent dated 14.06.2004 as being illegal and arbitrary and violative of Articles 14, 16, 21 and 300-A of the Constitution of India and consequently direct the respondents to continue the petitioner in service as watchman till he attains the age of 60 years and to pass such other necessary orders.

No representation on behalf of the petitioner on 30.03.2016 and the matter is posted to today 'for dismissal'. Today also even the matter is listed under the caption 'for dismissal', there is no representation on behalf of the petitioner. It seems that the petitioner is not interested to prosecute the matter.

Hence, the writ petition is dismissed for default. Consequently, the miscellaneous petitions if any pending in this writ petition shall stand closed.
