HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.35076 OF 2016 ORDER:

This Writ Petition is filed by the petitioners by invoking Article 226 of the Constitution of India seeking the following relief: ".... to issue a Writ or order or Direction in the nature of Writ of Mandamus declaring the action of the 3rd Respondent not disposing off application dated 1-92016 to correction of the Revenue Entries with regard to the land of Ac.1-16 cents in R.S.No.303/2 situated at Venkataramanujapuram Village, Tirumalapuram Revenue Mandal, Jangareddygudem Mandal, West Godavari District, is illegal, arbitrary and consequently direct the respondents 2 and 3 to delete the names of 4 and 5 respondents in on Line Revenue Records and enter the names of the petitioners and to pass such other orders."

Heard the learned counsel for the petitioners and the learned Asst. Government Pleader for Revenue (AP). With their consent, the Writ Petition is disposed of at the stage of admission itself. There is no necessity to put respondents 4 and 5 on notice as this Court is not venturing to adjudicate the issue on merits. Learned counsel for the petitioners mainly submits that without hearing and without putting the petitioners on notice, the respondents have made changes in the revenue records. Learned Assistant Government Pleader opposed the writ petition contending that the Tahasildar is empowered to make corrections, if the entries are made within one year and beyond that period it is only the Joint Collector, who is empowered to do so.

In reply, it is the argument of the learned counsel for the petitioners that the petitioners are not aware as to when such corrections are made.

Having regard to the rival submissions made, the writ petition is disposed of directing the respondent No.3 to consider the representation dated 01.09.2016 made by the petitioners seeking correction of entries and dispose of the same, if the same is still pending consideration, in accordance with law, after hearing the petitioners and also the aggrieved persons, if any, including respondents 4 and 5, as early as possible preferably within a period of six weeks from the date of receipt of a copy of this order. There shall be no order as to costs.

Miscellaneous petitions pending in this writ petition, if any, shall stand closed.
