This Writ Petition is filed for a Mandamus to declare the action of respondent No.4, in issuing proceeding No.A/62/A/2015, dated 06-12-2016, cancelling the assignment of the land admeasuring Acs.3-00 cents in Survey No.53 situated at Andugulapet Village, H/o. Mandamarri Mandal, in favour of the petitioner's father, as illegal and arbitrary. The petitioner sought for a consequential direction to respondent Nos.1 to 4 to reassign to the said land to the petitioner by cancelling ROR proceeding No.AP/20/1996, dated 05.09.1996, issued to respondent No.5.
Heard the learned Counsel for the petitioner and the learned Assistant Government Pleader for Revenue (TS) appearing for respondent Nos.1 to 4.
It is submitted by the learned Counsel for the petitioner that as against the impugned proceeding of respondent No.4, the petitioner has filed an appeal under the provisions of the Andhra Pradesh Assigned Lands (Prohibition of Transfers) Act, 1977, on 12-01-2017, and that the same was numbered as
ARR, J W.P.No.5864 of 2017 Dt: 20-02-2017 G/211/2017. The learned Counsel further submitted that though the appeal was filed within time along with the stay petition, no order has been passed by respondent No.3 in the stay petition.
Having regard to the aforesaid limited grievance of the petitioner, without going into the merits of the case, the Writ Petition is disposed of directing respondent No.3 to dispose of the appeal in accordance with law, after putting the petitioner and respondent No.5 on notice and after affording them an opportunity of hearing, within a period of two months from the date of receipt of a copy of this order.
As a sequel to disposal of the Writ Petition, WPMP.No.7160 of 2017, filed by the petitioner for interim relief, is disposed of as infructuous.
