THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.36958 of 2015 ORDER:

The complaint of the petitioner was that the Station House Officer, Rural Police Station, Mahabubnagar, the second respondent, was calling him to the police station and pressurizing him to execute a sale deed in respect of a plot in Sy.Nos.264 and 265 of Yenugonda Village, Mahabubnagar Mandal and District, pursuant to an alleged agreement of sale said to have been executed by the petitioner in favour of Vahini Finance Private Limited. A consequential direction was sought to the second respondent not to involve himself in the civil dispute pertaining to the subject land.

The Assistant Sub-Inspector of Police, Rural Police Station, Mahabubnagar District, furnished written instructions dated 18.11.2015 to the office of the learned Government Pleader for Home, wherein he denied the petitioner's allegations. He further stated upon the complaint lodged by one P. Indira Sena Reddy in respect of the subject land against the petitioner and the Managing Director of Vahini Finance Chit Funds Private Limited, Crime No.63 of 2008 had been registered under Section 420 I.P.C. on the file of the Rural Police Station, Mahabubnagar District. This case was stated to be pending trial vide C.C.No.112 of 2013 on the file of the learned Judicial Magistrate of First Class, Mahabubnagar District.

The Assistant SubInspector of Police denied the petitioner's allegation that he was called to the police station and detained there so as to pressurize him to execute a sale deed in favour of the third respondent. He also denied the allegation that the petitioner was telephoned to on 09.11.2015 and 10.11.2015 for the same purpose. In the light of the afore-stated stand of the police authorities, which is duly taken on record, no adjudication is warranted in this writ petition. The writ petition is accordingly closed. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
