Crl.R.C.M.P.No.4369 OF 2017 This miscellaneous petition is filed under Section 320(2) Cr.P.C seeking leave to compound the offence punishable under Section 138 of the Act. Learned counsel for the petitioner and the first respondent submits that the matter is settled out of the Court and filed a joint memo to that effect.
The petitioner and the first respondent are also present and they are identified by their respective counsel and produced Photostat copies of aadhar cards in proof of their identity.. When terms of compromise are explained in vernacular language, they are admitted to be true and correct. The petitioner/wife admitted that she received an amount of Rs.5,50,000/- in cash towards full and final settlement.
Hence, I find that the compromise is voluntary and permission is granted to compound the offence.
Hence, compromise is recorded in terms of the joint memo filed along with this petition. Accordingly, the petition is ordered. Crl.R.C. NO.2506 OF 2017 In view of the orders passed in Crl.R.C.M.P.No.4369 OF 2017, the present criminal revision case is allowed in terms of the joint compromise memo dated 20.10.2017.
MSM,J CRLRC.No.2506 of 2017 Registry is directed to annex a copy of the joint memo dated 20.10.2017 to this order.
Consequently, miscellaneous applications pending if any, shall stand dismissed. No costs.
