THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.16585 OF 2015 ORDER:
This Writ Petition is filed assailing the action of the registration authorities in refusing to receive and register the document presented by the petitioner in respect of his property in T.S.No.162/2 of Salur Village, Vizianagaram District.
The refusal by the registration authorities earlier in respect of the lands situated in this very same Survey Number fell for consideration before this Court in W.P.No.12481 of 2014. A copy of the order dated 23.04.2014 passed therein is placed on record. In the light of the above order and for reasons alike as were mentioned therein, this Writ Petition is disposed of directing the SubRegistrar, Salur, Vizianagaram District (3rd respondent) to receive and process the document presented by the petitioner in respect of the subject land. In the event the said document is found to fulfill the requirements of the Registration Act, 1908 and the Indian Stamp Act, 1899, the 3rd respondent shall complete the registration formalities and release the document in accordance with the due procedure. If, however, the 3rd respondent is of the opinion that the document presented for registration warrants denial, he shall pass orders in writing indicating the reasons for such refusal and communicate the same to the party in accordance with Section 71 of the Registration Act, 1908.
Pending Miscellaneous Petitions in this Writ Petition shall stand closed in the light of this final order. No order as to costs. __________________ SANJAY KUMAR, J June 12, 2015 MD
