THE HON'BLE SRI JUSTI CE A.RAMALI NGESWARA RAO Writ Petition No.5322 of 2018 Order:

This Writ Petition is filed challenging the action of the fourth respondent in not mutating the name of the petitioner in the revenue records and not issuing E-passbook and title deeds in respect of the property for an extent of Ac.13-84 cents, out of total extent of Ac.55-38 cents, situated in Survey No.74/2 and for an extent of Ac.6-06 cents, out of total extent of Ac.18-20 cents, situated in Survey No.79 of Peddannapalem village, Donakonda Mandal, Prakasam District. When the matter was adjourned for getting instructions, learned Government Pleader obtained written instructions from the fourth respondent stating that the land claimed was a settlement patta land and during field inspection it was noticed that the entire land was under possession of various ryoths.

The petitioner was not cultivating the land and he has no possession over the land. Though the petitioner was also present at the time of inspection of the land and when he was asked to show the possession, he failed to show his possession in respect of the land claimed by him. The pattadar passbooks were already issued in favour of third parties in respect of the land claimed by the petitioner and, in view of the same, if the petitioner has any grievance he has to file appropriate appeal against the said action.

In view of the instructions issued by the fourth respondent, it is open to the petitioner to obtain copy of the pattadar passbooks already issued in favour of third parties and take appropriate action challenging the same.

The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this writ petition shall stand closed.
