None appears for the petitioner.

This Writ Petition was filed seeking a direction to the respondents 1 and 2 to promote the petitioner to the post of Assistant Engineer in the existing vacancy on par with his juniors without reference to the pendency of disciplinary proceedings against the petitioner. Along with the Writ Petition the petitioner filed WPMP No.4837 of 2009 to consider his case for promotion. This Court recorded the contention of the learned counsel for the respondents that the case of the petitioner was not considered since he was facing an enquiry. However, this Court directed the respondents to consider the case of the petitioner for promotion to the post of Assistant Engineer, in any existing vacancy, if he is otherwise eligible as per law and pass appropriate orders within a period of four weeks and any promotion made shall be subject to the outcome of the enquiry.

Now, it is submitted by the learned counsel for the respondents that pursuant to the said order the case of the petitioner was considered and rejected on 11.03.2013. But, the petitioner has not taken any steps to challenge that order. Moreover, the petitioner might have retired from service also, as from the cause title it could be seen that he was aged about 50 years in 2009.

The Writ Petition is, accordingly, dismissed. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
