THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CIVIL REVISION PETITION NO.2283 OF 2016 ORDER:

Sri Atikam Srinivas Goud, learned counsel for the petitioner, seeks permission of the Court to withdraw the revision and requested one year time to vacate and deliver the vacant possession of the property to the landlords, the respondents herein since the premises is a commercial premises.

Sri Aadesh Varma, learned counsel for the respondents, did not agree for grant of one year time for vacating the schedule premises.

Permission is accorded for withdrawing the revision. Since the petitioner is allegedly carrying on business in the schedule premises, I find that it is appropriate to grant six (6) months time to vacate and deliver the vacant possession of the property to the respondent subject to deposit of arrears of rent within one month from today and shall continue to deposit the rent, agreed to be paid, on or before 5th of every month till delivery of vacant possession. In the event of failure to comply with any of the aforesaid directions, the respondents/landlords are at liberty to evict the tenant through process of law by executing the decree. With the above observations, the revision is dismissed as withdrawn. No order as to costs.

The miscellaneous petitions pending, if any, shall also stand closed.
