Petitioner was a driver. He assails the order of suspension dated 20.03.2017.

It appears that there was some incident involving the petitioner and other bus driver and conductor which resulted in initiation of disciplinary action in addition to registering of crime. 4.
It is not in dispute that the Depot Manager is competent to place the petitioner under suspension. It cannot be said that the allegations levelled against the petitioner, if proved, as not serious, warranting suspension of the petitioner. However, the Court is not entering into the merits of the allegations at this stage, as it would prejudice the proceedings in the disciplinary enquiry. Suffice to note that on the same day charge sheet was drawn and served on the petitioner. This Court is not inclined to interfere with the suspension order, having regard to the allegations made in the suspension order and charge sheet.

Learned counsel for the petitioner submits that petitioner has submitted his explanation today, to the charges levelled against him.

Having regard to the same, if the petitioner has submitted his explanation, the respondents are directed to hold and complete the disciplinary proceedings, as expeditiously as possible, preferably within a period of two (2) months from the date of receipt of copy of this order. For any reason the enquiry could not
- 3 - be completed and not attributable to the petitioner, the respondents shall review the desirability of further continuation of suspension of petitioner.

With the above observations, the writ petition is disposed of. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
