HON'BLE Dr. JUSTICE B.SIVA SANKARA RAO C.R.P.No.3484 OF 2015 ORDER :

Heard both sides. Perused the material available on record. This revision petition is maintained against granting of the interim order dated 19.08.2015 in I.A.No.531 of 2014 by the learned I Additional District and Sessions Judge, Sangareddy in pending C.M.A.No.16 of 2014 maintained impugning the order dated 12.03.2014 in I.A.No.60 of 2014 in O.S.No.21 of 2014 passed by the learned Senior Civil Judge, Zaheerabad. In the pending suit O.S.No.21 of 2014 for the relief of permanent injunction, temporary injunction was sought in I.A.No.60 of 2014 under Order 39 Rules 1 and 2 read with Section 151 of the Code of Civil Procedure and the trial Court vide order dated 12.03.2014 dismissed the same and impugning the same, C.M.A.No.16 of 2014 is filed and pending disposal of C.M.A., adinterim order of injunction was obtained in I.A.No.531 of 2014.

Practically, deciding of this revision petition by sitting against the interim order, pending C.M.A., comes another round of litigation against the trial Court's order. Instead of that, it is just to relegate both parties before the lower Appellate Court to seek for early disposal of the very C.M.A. itself.

Having regard to the above, without prejudice to contest of both parties, the civil revision petition is disposed of, by directing the I Additional District and Sessions Judge, Sangareddy, to dispose of the Civil Miscellaneous Appeal within one month from the date of receipt of a copy of this order. Both the parties are meanwhile directed to maintain status quo existing as on today till

DRSSRBJ disposal of the C.M.A.No.16 of 2014. There shall be no order as to costs.

As a sequel, miscellaneous petitions, if any, pending in the revision shall stand closed.
