THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.23236 of 2011 ORDER:

It is the case of petitioner that an extent of Ac.0.92 cents of agricultural land situated in Survey No.108-1 C B and 108-2G of Palasamudram Village, Gorantla Mandal of Anantapur District was assigned to one Hanumanthappa in the year 1928 and after the death of Hanumanthappa, mutation was effected in the name of his son Harijana Badrappa. The said Harijana Badrappa sold the property to one P.Ramakrishna Reddy, who in turn sold the land in favour of the petitioner on 26.05.2005. It appears that a news item was published in the Telugu daily viz., Sakshi of Anantapur District Edition in the month of August 2011 stating that the Government is intending to take possession of the land situated in various survey numbers including the land of petitioner for formation of S.E.Z. At that stage, the present writ petition was filed stating that the petitioner was being dispossessed from the land.

This Court, by order dated 18.08.2011, directed the respondents not to dispossess the petitioner from the land in question without following due process. Seeking vacation of the said order dated 18.08.2011, W.V.M.P.No.96 of 2012 was filed by the respondents. The respondents stated that on the requisition of the Zonal Manager, A.P.I.I.C., Anantapur, dated

ARLR, J W.P. No.23236 of 2011 10.03.2011, it was proposed to acquire an extent of Ac.184.66 cents of land including Ac.4.00 cents of patta land for the purpose of establishment of Industrial Park at Palasamudram Village of Gorantla Mandal. In connection with the same, a survey was conducted and at that stage, the present writ petition was filed.

At the time of filing the writ petition as well as now, no notification was issued under the provisions of the Land Acquisition Act and the petitioner's apprehension that he would be dispossessed without following the due process of law has no basis.

In the above circumstances, this Writ Petition is disposed of making the interim order dated 18.08.2011 as final order. No order as to costs. Miscellaneous Petitions pending, if any, shall stand closed.
