Jatangi Murali v. S. Venkataiah And Another
HON'BLE JUSTICE G. SRI DEVI CRIMINAL REVISION CASE No.72 of 2020 ORDER :
This Criminal Revision Case under Sections 397 and 401 Cr.P.C. is filed by the petitioner-accused to set aside the order, dated 06.01.2020 passed in Crl.M.P.No.15 of 2020 in Crl.A.No.5 of 2020 by the VIII Addl. District and Sessions Judge, Ranga Reddy at L.B. Nagar.
2.
As seen from the record, it is clear that the learned Sessions Judge, vide impugned, suspended the operation of the sentence passed by the trial Court till disposal of the appeal on the petitioner depositing a sum of Rs.40,000/-of the compensation amount in the trial Court within one month. Hence, this revision.
3.
Heard the learned counsel for the petitioner and perused the material on record.
4.
Learned counsel for the petitioner submits that the direction given by the learned Sessions Judge to deposit Rs.40,000/- of the compensation amount while suspending the sentence is excessive and in fact, the complainant has no capacity to lend the amount to the petitioner and hence, he prays to set aside the order.
5.
Having regard to the facts and circumstances of the case and the submissions made by the learned counsel for the petitioner, the petitioner is directed to deposit 15% of the compensation amount i.e., Rs.30,000/- instead of 20% of
the compensation amount within a period of one month from today before the trial Court.
6. With the above direction, the Criminal Revision Case is disposed of. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
