THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.37216 of 2015 ORDER:
The grievance of the petitioner was as to the alleged inaction on the part of the Station House Officer, Chatrinaka Police Station, Hyderabad, in concluding investigation in Crime No.307 of 2013 on the file of the said police station.
Written instructions dated 02.12.2015 were furnished by the Sub-Inspector of Police, Chatrinaka Police Station, Hyderabad City, to the office of the learned Government Pleader for Home, wherein it was stated that upon the petitioner's complaint dated 14.04.2015, Crime No.307 of 2013 was registered under Sections 384 and 506 I.P.C. read with Section 34 I.P.C. on the file of Chatrinaka Police Station. However, upon due investigation, the police authorities found that no case was made out for proceeding further and accordingly filed a final report under Section 173(2) Cr.P.C. before the learned Chief Metropolitan Magistrate, Hyderabad, vide SR.No.6226 of 2015 dated 30.11.2015 referring the case for 'Lack of Evidence'. Notice of the filing of the final report was also given to the complainant, the petitioner.
In the light of the aforestated developments, the cause in this writ petition no longer survives for consideration. In the event the petitioner is aggrieved by the final conclusion arrived at by the police authorities, it is for him to take appropriate measures in accordance with law.
Reserving liberty to the petitioner to do so, the writ petition is dismissed.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
