THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO WRIT PETITION No. 10248 OF 2015 O R D E R:
The petitioner has retired from the service of the government having worked as a Craft Instructor in Government ITI at Ongole, Prakasam District. Her grievance is that when certain bills have been presented by the Principal of the said ITI to the District Treasury at Ongole, the Treasury Officer has returned the same raising certain objections. The Principal of the ITI, instead of resubmitting the bill appropriately answering the objections raised, has sought for clarification from the Commissioner of Employment and Training, the Head of the Department and the Head of the Department has not bothered to answer the questions, as a result, certain financial benefits, which the petitioner is otherwise entitled to, have been withheld. This grievance of the petitioner is arising out of the conditions of service of a government servant.
Therefore, as per the dicta laid down by the Supreme Court in L. Chandra Kumar v. Union of India, such grievance must be sought for redressal, at the first instance, by approaching the Andhra Pradesh Administrative Tribunal and only thereafter, if it is still subsisting, the petitioner can seek judicial review thereof by approaching a Division Bench. The petitioner cannot approach, for the first time, this Court seeking redressal of her grievance. Hence, preserving the liberty to the petitioner to approach the Andhra Pradesh Administrative Tribunal and seek redressal of her grievance, this Writ Petition is dismissed. No costs.
