HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.1242 of 2020 ORDER:
Heard the learned counsel for the petitioner as well as Sri D.Prakash Reddy, learned Senior counsel, appearing for the learned counsel for respondent Nos.9 and 10 and the learned Standing counsel appearing for the 4th respondent authority. In the counter affidavit filed by respondent No.4, it is mentioned that letter dated 19.12.2019 submitted by the petitioner was received by the 4th respondent authority in inward section on 20.12.2019. Pursuant to the said letter, an explanation was sought for from respondent Nos.9 and 10 and the matter is under examination. It is also mentioned that the complaint was received after releasing the draft layout dated 22.03.2018 i.e., after one year nine months.
Per contra, learned Senior counsel appearing for respondent Nos.9 and 10 submits that respondent Nos.9 and 10 have not received any notice/letter from the 4th respondent till date. Learned Standing counsel appearing for the 4th respondent submits that the 4th respondent authority will issue notice/letter once again, whereupon respondent Nos.9 and 10 may be directed to submit their explanation and upon which appropriate orders will be passed.
Having heard both the counsel, respondent No.4 authority is directed to serve the notice/letter on respondent Nos.9 and 10 within one week from the date of receipt of a copy of this order and
respondent Nos.9 and 10 are directed to submit their explanation within three weeks thereafter. Till the final orders are passed, respondent Nos.9 and 10 are directed not to sell any plots in the subject site based on the tentative layout.
With the above observations, the writ petition is disposed of. No order as to costs.
