HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No. 5553 of 2009 Order:
This Writ Petition was filed challenging the action of the respondent in not issuing "Form-L" permit of dispatch of Minor Mineral under Rule 34 for the road metal and building stone already quarried by the petitioner from the quarry situated in Survey No.109 of Mamidipalem village, Anankapalli Mandal, Visakhapatnam District, even though he paid the entire seigniorage fee.
2. This Court, by an order dated 18.03.2009, while admitting the Writ Petition, directed the respondent to issue dispatch permits provided the petitioner paid the required seigniorage fee as per the orders in WP No.25356 of 2007.
3. Since the relief sought in the main Writ Petition is for issuance of dispatch permits to the extent of road metal and building stone already quarried from the leased area and, by virtue of the interim order it worked out itself, no further orders need be passed in the Writ Petition. The Writ Petition has become infructuous.
4. The Writ Petition is, accordingly, dismissed as infructuous. However, in the circumstances, no costs.
5. As a sequel thereto, the miscellaneous applications, if any, pending in this Writ Petition shall stand closed. ________________________ A.
