THE HON'BLE SRI JUSTICE T.VINOD KUMAR WRIT PETITION No.1132 of 2020 ORDER:

The present writ petition is filed to declare the inaction of the respondents in taking action against respondents 6 & 7 for making illegal constructions without obtaining any permission and layout, from the 5th respondent, of the land admeasuring to an extent of 211.00 square yards and 213.00 square yards, in Survey No.296/H, situated at Mulkanoor Village, Chigurumamidi Mandal, Karimnagar District, without considering the representations of the petitioner, dated 06.01.2020, 12.12.2012, 10.12.2012 and 30.11.2019, as arbitrary, illegal and contrary to the provisions of the Telangana Panchayat Raj Act, 2018.

Heard Sri G.Madhusudhan Reddy, learned counsel for the petitioner, learned Government Pleader for Panchayat Raj for respondents 1 to 4, and Sri G.Narender Reddy, learned Standing Counsel for the 5th respondent.

Sri G.Narender Reddy, learned Standing Counsel for the 5th respondent, submits that though respondents 6 & 7 initially commenced construction in the subject land without obtaining any permission, thereafter the said respondents made an application to the 5th respondent for according permission for proceeding with the construction and the said application is under consideration.

In view of the above submission made by the learned Standing Counsel for the 5th respondent, this Court is of the view that while considering the application said to have been submitted by respondents 6 & 7 to the 5th respondent for according permission, the 5th respondent shall also take into consideration the objections raised by the petitioner by way of representations, dated 06.01.2020, 12.12.2012, 10.12.2012 and 30.11.2019, and decide the matter, in accordance with law.

With the above observation, the Writ Petition is disposed of.
