HONOURABLE SRI JUSTICE CHALLA KODANDA RAM CONTEMPT CASE No.1319 of 2017 ORDER:

The Contempt Case is filed alleging non-compliance of the order of this Court in W.P.No.9661 of 2017 dated 23.03.2017.

This Court, by order dated 23.03.2017 in W.P.No.9661 of 2017, disposed of the writ petition with a direction to consider the complaint of the petitioner with respect to the illegal activities of respondent No.6 within a period of four weeks from the date of receipt of the order. Today, learned Government Pleader of Mines and Geology placed on record the order dated 11.07.2017 passed after considering the complaint of the petitioner. Learned counsel for the petitioner submits that there is total non-application of mind in passing order dated 11.07.2017; and, hastily, the Deputy Director of Mines and Geology passed the order without even waiting for report from the Assistant Director of Mines and Geology and had given a clean chit to respondent No.6 in the writ petition. He, however, submits various aspects on merits of the case. Though it may be a case where the petitioner has grievance with respect to the merits of the order passed, the contempt jurisdiction being limited, and considering the nature of the order made in the writ petition, it is not

within the scope of contempt jurisdiction to delve into the merits of the case.

In the circumstances, the Contempt Case is closed. However, liberty is given to the petitioner to assail the order dated 11.07.2017 pointing out defects. No order as to costs.
