Heard learned counsel for the petitioner/accused before admission and before notice to the 2nd respondent/de facto complainant and also heard the learned Public Prosecutor representing the 1st respondent State and perused the grounds and the impugned order passed by the learned Special Magistrate in dismissing the warrant recall application, that too filed without presence. 2.

There are no grounds to interfere with the order of the Court, but for giving liberty by virtue of this order to file fresh application with presence to consider for the recall on imposing penalty on the earlier bond executed.

Accordingly, the Criminal Petition is disposed of. Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence.
