2017-03-10Challa Kodanda Ram2 pages

THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.8443 OF 2017 ORDER:

Aggrieved by the demand notice dated 01.08.2016, the petitioner filed revision before the first respondent on 24.10.2016. The petitioner asserts that though he filed revision along with stay application, neither the stay application nor the revision has been disposed of. He further asserts that the respondents are now seeking to enforce the demand made in the impugned demand notice.

The aspect of revision being filed by the petitioner and the same being pending is not disputed. In the facts of the present case, without expressing any opinion, interest of justice would be served if a direction is issued to the revisional authority to dispose of stay application or revision within three months from the date of receipt of a copy of this order. Till the disposal of stay application or revision by the revisional authority, the impugned demand notice, date 01.08.2016 shall be kept in abeyance. With the above observation, the Writ Petition stands disposed of.

Miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
