O R D E R
The prayer of the petitioner in this writ petition is that the police authorities should be directed to act upon the request of the Andhra Pradesh State Wakf Board under its letter dated 18.09.2014 and the request of the District Collector, Kurnool, under his letter dated 09.10.2014. These communications were addressed in the context of the alleged grabbing of the wakf lands at Pyalakurthi Village, Kodumur Mandal, Kurnool District. The petitioner is the Muthawalli of Jamia Masjid at Pyalakurthi Village.
Written instructions were furnished to the office of the learned Government Pleader for Home by the Sub-Divisional Police Officer, Kurnool, wherein he stated that upon the complaints received in relation to the subject lands, Crime No.208 of 2014 was registered on the file of Kodumur Police Station under Sections 447 and 427 IPC read with Section 34 IPC. The charge-sheet was laid after completion of the investigation before the learned Judicial First Class Magistrate, Kurnool, and was taken on file vide C.C.No.224 of 2015. The Sub-Divisional Police Officer further stated that no complaint was received thereafter as to any trespass by any third party.
In the light of the aforestated steps taken by the police authorities, it is clear that the requests made by the authorities concerned have been acted upon. However, in the event there is any threat of trespass over the wakf lands belonging to Jamia Masjid, it shall be open to the petitioner to forthwith inform the police authorities of the same and necessary steps shall be taken upon such complaint to prevent the commission of any cognizable offence by exercise of powers under Section 149 Cr.P.C. The writ petition is disposed of with the above directions. Pending miscellaneous petitions shall stand closed. No order as to costs.
