- 2 - THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.1190 OF 2018 ORDER :

Petitioner is an employee in Government Junior College. Since he is in the employment of government service for adjudication of grievances arising out of Government service, petitioner has to invoke the jurisdiction of Andhra Pradesh Administrative Tribunal constituted under Section 15 of the Administrative Tribunals Act, 1985 (for short 'the Act'). As held by the Hon'ble Supreme Court in L. Chandra Kumar Vs Union of India1, since the Administrative Tribunal is the Court of first instance, without availing the remedy available under the Act, petitioner cannot directly invoke the jurisdiction of this Court. Writ Petition is accordingly dismissed leaving it open to the petitioner to avail the remedy available under the Administrative Tribunals Act. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
