THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.1255 OF 2018 ORDER:
The petitioner claims to be the absolute owner of agricultural land admeasuring Acs.2.60 guntas situated in Survey No.8-B, Sattenapalli Village and Mandal, Guntur District, having acquired the same under gift deed executed by her parents and registered on 11.12.2006. Their parents acquired the same through the petitioner's grandfather under a Will dated 28.06.1993. Originally, the land was purchased by their ancestors on 02.10.1962 through a registered document. The grandfather's name was entered into revenue records as the original pattadar and patta was issued in the year 1962 under Laoni Rules. As per the Laoni Rules, the land is heritable. The petitioner was issued pattadar pass books and title deeds on 08.01.2009. However, due to political rivalry, a notice, dated 21.11.
2017, was issued by the fourth respondent asking the petitioner to submit her explanation as to why action shall not be taken under the provisions of the A.P.Assigned Lands (Prohibition of Transfers) Act and the Rules made thereunder. The petitioner submitted her reply on 26.12.2017. Now the present writ petition is filed alleging interference by the fourth respondent without passing a final order.
In view of the submission of an explanation by the petitioner to the notice issued by the fourth respondent on 21.11.2017, the fourth respondent shall not interfere with the possession of the petitioner without passing final orders. If final orders are passed and they are adverse to the interest of the petitioner, the same shall not be implemented for a period of thirty days in order to enable the petitioner to take appropriate steps against the said order.
The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any pending, in this writ petition, shall stand closed. There shall be no order as to costs.
