THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.12953 of 2002 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the proceedings dated 15.07.2002 disengaging the services of the petitioner with effect from 16.07.2002, as illegal and arbitrary.

While admitting the writ petition, this Court granted interim suspension of the impugned order to the extent of the petitioner alone, vide orders dated 18.07.2002 in WPMP No.16096 of 2002. Subsequently, the said orders were vacated vide orders dated 09.02.2004 in WVMP No.105 of 2004. However, the respondents are directed to consider the case of the petitioner for re-engagement of his services in accordance with the provisions of Section 25-G of the Industrial Disputes Act, 1947.

When the matter is taken up for hearing, learned counsel for the petitioner submits that in view of the aforesaid orders passed by this Court, the cause in the writ petition does not survive. Having considered the submission of the learned counsel for the petitioner and perused the record, this Court is of the view that if the petitioners are reengaged, their services shall not be disturbed. With the above observation, the writ petition is closed. Consequently, miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
