HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.202 of 2017 ORDER:

This writ petition is filed by the petitioners under Article 226 of the Constitution of India seeking a direction to the respondents not to evict them from the land admeasuring Ac.20.65 cents in R.S.Nos.299/1 and 299/2 of Dorasanipadu Village, Dwaraka Tirumala Mandal, West Godavari District.

It is the case of the petitioners that they inherited the subject property from their ancestors and they have been in possession and enjoyment of the same. When the petitioners made an application before the 4th respondent for grant of pattadar pass books and title deeds in their favour, an application was moved before the 5th respondent to take steps to evict the petitioners. Apprehending dispossession, the petitioners filed this writ petition.

Learned Counsel for the petitioners submitted that a direction may be given to the respondents not to dispossess the petitioners without following due process of law.

Considering the facts and circumstances of the case, without expressing any opinion on merits, this Court is inclined to pass the following order:

"The respondents are directed not to dispossess the petitioners from the subject lands, if they have any title over the subject land."

With the above direction, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed. ________________ RAJA ELANGO, J Date: 3rd January, 2017 Nn
