Since the facts involved in both the Writ Petitions are similar, they are being disposed of by this common order.
Heard learned counsel for the petitioners and learned Government Pleader for the respondents.
In spite of granting time on 24.01.2018, learned Government Pleader did not get instructions, but he was asked to take time in view of the engagement of the Tahsildar in the survey and land verification updating work.
It is the case of the petitioners that they purchased the land of an extent of Ac.8-27 gts., and Ac.8-27 gts., respectively, situated in Survey No.108/4 to 17 of Pashamailaram village, Patancheru Mandal, Sangareddy District, under registered sale deeds both dated 05.11.2016 from one Marri Robert Lincolin, Marri Shobha Bheema Latha, Marri Immanial Jocob @ Marri Anurag Jain and Smt. G. Kamalamma. It appears that the said lands along with other lands in an extent of Ac.56.33 gts., were initially assigned under Special Lavani to various persons by proceedings dated 01.10.1953 and another extent of Ac.5.32 gts., was assigned on payment of market value. Both the lands are situated in Survey No.108 of Pashamailaram village. The pattas were issued in respect of nineteen
(19) people at the rate of Ac.2-00 each. Their names were mutated in the revenue records. On the death of some of the original allottees, their legal heirs sold the land of an extent of Ac.17.27 gts., in favour of the vendors of the petitioners and the land was given sub-division numbers 108/4 to 17. While so, the then Mandal Revenue Officer resumed the said
land by proceedings dated 18.02.1989 in contravention of Section 3 of the A.P. Assigned Lands (Prohibition on Transfer) Act, 1977, and restored the possession of the land to the individuals who alienated the same. When an appeal was filed, the appeal was allowed and the matter was remanded to the District Revenue Officer by proceedings of the District Collector, Medak, dated 09.03.1989. The District Revenue Officer, Medak heard the matter and passed an order on 30.07.1990 quashing the resumption proceedings passed by the Mandal Revenue Officer on 18.02.1989 and directed him to restore the entries for the land of an extent of Ac.17.27 gts., situated in Survey No.108/4 to 17 in favour of the vendors of the petitioners. The said order has become final.
The names of the vendors of the petitioners were restored by proceedings of the fourth respondent dated 16.05.2015. Thereafter, the vendors of the petitioners sold the extent of Ac.8-27 gts., and Ac.8-27 gts., as aforesaid. After purchase of the property by the petitioners, they submitted applications for mutation of their names on 03.11.2017 while enclosing the copies of registered sale deeds and relevant documents. When no action was taken by the fourth respondent, the present Writ Petitions are filed.
In view of the above facts, now it is for the fourth respondent to consider the request made by the petitioners for mutation of their names consequent to their purchase under registered sale deeds dated 05.11.2016. The fourth respondent is, accordingly, directed to consider the applications submitted by the petitioners on 03.11.2017 and dispose of the same in accordance with law within a period of four (4) weeks from the date of receipt of a copy of this order.
The Writ Petitions are, accordingly, disposed of. There shall be no order as to costs.
As a sequel thereto, the miscellaneous petitions, if any, pending in these writ petitions shall stand closed.
