THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NO.32822 OF 2015 ORDER:

The petitioner was appointed as a fair price shop dealer of shop No.539 at Door No.33-3, Rajeev Gandhi Nagar, I.D.A., Jeedimetla, Quthbullapur Mandal, Ranga Reddy District, and his authorization is valid up to 31.03.2017. While so, on 15.06.2015, the fourth respondent inspected the petitioner's fair price shop and based on his report, the third respondent issued a show cause notice dated 12.08.2015. The petitioner submitted his explanation to the show cause notice on 10.09.2015. But the third respondent has not passed any order on his explanation till date and further, stopped supply of essential commodities to the petitioner. So far the authorization of the petitioner is neither suspended nor cancelled. Challenging the action of the respondents in not supplying the essential commodities, the present Writ Petition is filed.

Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies for the respondents. The petitioner was appointed as a fair price shop dealer of shop No.539 Rajeev Gandhi Nagar, I.D.A., Jeedimetla, Quthbullapur Mandal, Ranga Reddy District. The authorization of the petitioner is subsisting as on today. As long as the authorization of the petitioner is in force, the petitioner is entitled for supply of essential commodities. Only a show cause notice is issued to the petitioner by order dated 12.08.2015.

In the circumstances, the Writ Petition is, disposed of directing the third and fourth respondents to supply essential commodities to the petitioner so long as the authorization of the petitioner is in force. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed. ________________________ (A.RAMALINGESWARA RAO, J)
