HON'BLE SRI JUSTICE SURESH KUMAR KAIT CRIMINAL PETITION No. 17068 of 2016 O R D E R:

Vide the present petition, the petitioners/A.16 to A.18 and A.31 seeks direction thereby to grant anticipatory bail, in the event of their arrest, in connection with Crime No.245 of 2016 of Bhongir Town Police Station, Nalgonda District, registered for the offences punishable under Sections 447, 427, 387, 506 IPC. 2.

Learned counsel, appearing on behalf of the petitioners, submits that the names of the petitioners were not in the F.I.R., however, they are implicated on the confessional statement of the coaccused, which is not admissible as per Section 26 of the Indian Evidence Act.

Learned Additional Public Prosecutor, appearing on behalf of the respondent-State, states that there are six other similar cases pending against petitioner Nos.1 to 3/A.16 to A.18 and two other similar cases are already registered against petitioner No.4/A.31 and, thus, they are habitual offenders and until they are taken into judicial custody, the crime would not be unearthed. 4.

Keeping in view the serious allegations against the petitioners and that they are habitual offenders, I am of the considered view that in the present case, the petitioners are not entitled to anticipatory bail.

Accordingly, the Criminal Petition is dismissed. 6.

As a sequel, Miscellaneous Petitions, if any pending in this petition, shall stand closed.
