HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No. 15951 of 2011 Order:

This Writ Petition was filed challenging the action of the fifth respondent in not sending 'No Objection Certificate' to the Assistant Director of Mines and Geology about classification and availability of the land applied by the petitioner for grant of quarry lease as per GO Ms. No.181, Industries and Commerce (Mines.I) Department, dated 28.05.1998, for an extent of Ac.2-000 Hectares in Survey No.901 of Kotrepalli village, Baireddypally Mandal, Chittoor District.

2. This Court, by an order dated 10.06.2011, directed the fifth respondent to complete the enquiry and send the report forthwith to the Assistant Director of Mines and Geology concerned.

3. When the matter is taken up for hearing, learned counsel for the petitioner submits that pursuant to the said direction, no objection was sent to the Assistant Director of Mines and Geology who executed a lease in favour of the petitioner and the petitioner has been continuing the quarrying operations.

4. In view of the same, nothing survives for consideration in the Writ Petition and the Writ Petition is, accordingly, closed. There shall be no order as to costs.

5. As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
