THE HON'BLE SRI JUSTICE SANJAY KUMAR AND THE HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.15973 of 2016 ORDER: (per Hon'ble Sri Justice Sanjay Kumar) Challenge in this writ petition was to the auction notice dated 27.04.2016 issued by the respondent bank with regard to sale of the secured immovable assets.

By order dated 12.05.2016, this Court granted interim stay of further proceedings pursuant to the impugned auction sale notice. Sri Podili Hari Prasad, learned counsel for the respondent bank, would however state that the sale proposed to be held on 12.05.2016 pursuant to the impugned auction sale notice did not materialise for want of bidders. That being so, the challenge in this writ petition is rendered purely academic and does not warrant consideration on merits.

The writ petition is accordingly dismissed leaving all issues open. This order shall not preclude the petitioners from seeking redressal of their grievance, if any, in future in accordance with law. Interim order dated 12.05.2016 shall stand vacated. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
