HON'BLE SRI JUSTICE R. SUBHASH REDDY And HON'BLE SRI JUSTICE A. SHANKAR NARAYANA WRIT PETITION No.37166 of 2015 ORDER : (Per Justice R.Subhash Reddy) This writ petition is filed with the prayer, which reads as under :

"to issue a Writ, order or direction, more particularly one in the nature of a Writ of Mandamus declaring the action of the Respondent (Special Tribunal) particularly, in dealing with the case in L.G.O.P.No.940 of 1990 as arbitrary, illegal, violative of principles of natural justice and unconstitutional and consequently direct the Respondent (Special Tribunal) to hold enquiry in L.G.O.P.No.940 of 1990 on day to day basis for expeditious disposal of the case impartially without any bias or prejudice."

In earlier round of litigation, in W.P.No.1976 of 2009, this Court, by judgment dated 16.02.2009, while upholding the order of Special Court, remitted the matter to the Special Tribunal directing the Tribunal to dispose of the matter as expeditiously as possible, preferably within a period of six months from the date of receipt of said order. It is submitted that even by this time, the said O.P. is not disposed of.

As much as initially the L.G.O.P. was dismissed in the year 1990, which order was reversed by the Special

Court and the said order of Special Court is confirmed by this Court in the earlier writ petition in W.P.No.1976 of 2009, we deem it appropriate to dispose of this writ petition directing the respondent-Special Tribunal to dispose of L.G.O.P.No.940 of 1990, as expeditiously as possible, preferably within a period of four months from the date of receipt of this order.

Subject to above direction, the writ petition is disposed of. No order as to costs.

Pending miscellaneous applications, if any, shall stand closed.
