2017-04-21A Ramalingeswara Rao1 pages

THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.14435 of 2017 ORDER:

This Writ Petition is filed challenging the action of the third respondent in harassing the petitioners by calling to the Police Station frequently and threatening them based on FIR No.117 of 2017.

The main grievance of the petitioners is that they are eking out their livelihood by doing petty business. Petitioner Nos.1 and 2 are accused Nos.2 and 6 in the above FIR and the other petitioners are no way connected with the said crime. But, the third respondent is insisting them to appear before the Police for investigation and the third respondent is not following due process of law. If that is the grievance, it is needless to observe that the third respondent shall follow due process of law, including compliance with Section 41-A of Cr.P.C, while investigating the crime.

The Writ Petition is, accordingly, disposed of with the above observation. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
