HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.1226 of 2020 ORDER:

Heard the learned counsel for the petitioners as well as the learned Standing counsel appearing for the 2nd respondent authority.

The prayer sought in the writ petition is as under: "... to issue Writ of Mandamus or any other appropriate Writ, Order or direction directing the respondents not to proceed with the digging up activities in petitioners land admeasuring Ac.5-22 guntas in Survey No.132(P) and 133(P) situated in Kandlakoya Village, Medchal Mandal, Medchal-Malkajgiri District by declaring the action of the respondents in trying to take up digging activities through petitioners land admeasuring Ac.5-22 guntas in Survey No.132(P) and 133(P) situated in Kandlakoya Village, Medchal Mandal, Medchal-Malkajgiri District purportedly for laying road without following due process of law more particularly without acquiring the land and paying compensation for the same in accordance with law is illegal and arbitrary and also in violation of Articles 14, 21 and 300-A of the Constitution of India." During the course of hearing, the learned Standing counsel placed on record letter dated 22.01.2020 addressed to him by the 4th respondent. The same is made part of the record.

From a perusal of the said letter, it is revealed with regard to the contentions raised by the 1st petitioner regarding acquisition of land in Sy.Nos.132 and 133, that the Hyderabad Growth Corridor Limited (HGCL) has not entered into Sy.Nos.132 and 133 for any development work or formation of roads. Therefore, the contentions made by the 1st petitioner are false.

In the light of the above said letter and the statements made there in by the 4th respondent, this Court is of the opinion that the writ petition is pre-mature and the same is liable to be closed.

Accordingly, the writ petition is closed. No order as to costs.
