THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY CRIMINAL PETITION No.8209 of 2017 ORDER:

This petition is filed under Section 482 Cr.P.C. seeking for relaxation of the condition imposed in the order dated 06.07.2017 in Crl.M.P.No.2164 of 2017 in Crime No.251 of 2017 on the file of the Court of the I Additional Metropolitan Sessions Judge, Hyderabad.

A perusal of the record reveals that the petitioner is accused No.1 in Crime No.251 of 2017 on the file of the Station House Officer, Saifabad Police Station, Hyderabad, for the offences punishable under Sections 3, 4, 5, 6 and 7 of the Immoral Traffic (Prevention) Act, 1956 and Section 370 and 370(A)(ii) I.P.C. The trial Court released the petitioner on bail on 06.07.2017 in Crl.M.P.No.2164 of 2017 directing the petitioner to appear before the Station House Officer, Saifabad Police Station, on every Sunday at 10:30 AM till filing of the charge sheet.

The learned counsel for the petitioner and the learned Additional Public Prosecutor submitted that so far the investigating agency has not completed the investigation.

Taking into consideration the nature of the offences alleged to have been committed by the petitioner, the trial Court directed the petitioner to appear before the Station House Officer, Saifabad Police Station, on every Sunday at 10:30 AM and imposing of such condition is not an onerous one. This Court shall not lightly interfere with the discretionary orders passed by the Court below.

Viewed from any angle, I am of the considered view that imposing of the condition on the petitioner to appear before the Station House Officer, Saifabad Police Station, Hyderabad, on every Sunday at 10:30 AM till filing of the charge sheet is not an onerous one.
