THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 1357 of 2019 O R D E R:

Petitioner asserts that he has interest in the property in Survey Nos.721 and 722 of Korremul Village, Ghatkesar Mandal, Ranga Reddy District and that he filed O.S.No.71 of 2018 against respondent Nos.5 and 6 for declaration and injunction with respect to the said property in the Court of V Additional District Judge, Ranga Reddy at L.B.Nagar. He further asserts that there is a dispute with respect to the title to the said property, as such, respondent Nos.5 and 6 have no manner of right to get the layout sanctioned and that he filed his objections to respondent No.2Hyderabad Metropolitan Development Authority on 15.12.2018 on the application made by respondent Nos.5 and 6 seeking to grant layout approval. His grievance is that the respondent authorities have not acted upon the objections filed by him. Hence, he prays for a writ of Mandamus.

Heard learned counsel for the petitioner.

Learned Standing Counsel for respondent No.4 submits that as a matter of fact, few individuals had applied for regularisation of their plots under the Scheme notified by the Government and they have been granted.

Learned Standing Counsel for respondent Nos.2 submits that the objections raised by the petitioner shall be considered in

accordance with law before granting layout approval to respondent Nos.5 and 6.

In those circumstances, the writ petition is disposed of with the direction to the respondent authorities to consider the objections filed by the petitioner while dealing with the application filed by respondent Nos.5 and 6, particularly, keeping in view the fact that the petitioner filed O.S.No.71 of 2018. Miscellaneous petitions, if any, pending in this writ petition shall also stand disposed of. There shall be no order as to costs. _________________________ CHALLA KODANDA RAM, J Dt:28.01.2019 kdl
