THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION NO.15950 OF 2016 ORDER:

Heard Sri Srinivasa Murthy Cheedella, learned counsel appearing for the petitioners and the learned Assistant Government Pleader for Revenue.

Learned Assistant Government Pleader draws the attention of the Court to Annexure P1 and contends that even assuming that there is assignment of any portion which the petitioners claim right and title in favour of respondent No.4, the same is an appealable order and no extraordinary or exceptional circumstances are made out for entertaining the instant Writ Petition.

Learned counsel appearing for the petitioners submits that no doubt the order is appealable but the petitioners are prevented from availing the remedy of appeal at the earliest point of time, as they did not have the copy of assignment in their favour. Having regard to above circumstances, the Writ Petition is disposed of by this order.

The petitioners are given liberty to avail the remedy of appeal within four (4) weeks from today. The parties are directed to maintain status quo for a period of four (4) weeks from today. It is open to the petitioners to obtain further orders from the appellate authority in the appeal they intend to file.

There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
