THE HONOURABLE SRI JUSTICE C.V. BHASKAR REDDY CONTEMPT CASE No. 350 OF 2019 ORDER:

This Contempt Case is filed alleging violation of orders dated 28.09.2018 passed by this Court in W.P.No.31253 of 2018.

By the above said order, this Court disposed of the said writ petition directing the respondents to dispose of the representation submitted by the petitioner dated 31.07.2018 and take appropriate action in accordance with law. 3.

This Court on 09.04.2019 passed the following order in the contempt case:

"Registry is directed to issue notice to respondent Nos.2 and 3 to show cause as to why they should not be punished under the Contempt of Courts, Act, 1971, for non-compliance of order, dated 28.09.2018, passed by this Court in W.P.No.31253 of 2018, by filing counter affidavits on or before 07.06.2019, failing which, they shall appear before this court on that date at 2.15 p.m.

It is made clear if the counter affidavits are not filed on the date specified, the same shall not be accepted without payment of costs of Rs.2,000/- each by respondent Nos.2 and 3."

It has not stated in the counter affidavit filed by the Municipal Commissioner dated 01.07.2019 about the payment of the costs. However, the delay in the disposal of the representation of the petitioner as directed by this Court, he tendered unconditional apology.

The unconditional apology tendered by the Municipal Commissioner is taken on record and the contempt case is closed. However, respondent Nos.2 and 3 are directed to pay the costs of Rs.5,000/- in favour of Telangana High Court Advocates Association, for not filing counter affidavit as directed on 19.04.2019, failing which, the petitioner is granted liberty to seek revival of the contempt case in accordance with law. Miscellaneous Petitions, if any, pending in this contempt case shall stand closed.
