THE HONOURABLE MR JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.27305 of 2015

ORDER

Heard learned counsel for the petitioner and learned Government Pleader for Revenue for respondents.

2. The grievance of the petitioner is that the entries in the revenue records with regard to the land to an extent of Ac.5.14 gts in Sy.No.301 situated at Pakala Village, Kodakandla Mandal, Warangal District, have not been corrected in spite of the directions of the District Collector in Rc.No.F2/2648/2015 dated 30.04.2015 addressed to the 4th respondent. Petitioner states that his father's name i.e., Udutha Yakaiah was shown in the revenue records. Thereafter, the petitioner has been in continuous possession and enjoyment of the land as is evident from the revenue entries. He also states that he obtained a decree for declaration of title and permanent injunction in O.S.No.99 of 2012 on the file of Junior Civil Judge, Thorrur, and in spite of that, the pahani entries are not corrected by the 4th respondent. Therefore, the petitioner made an application before the District Collector, but in spite of the directions dated 30.04.2015 of the District Collector, no further action is taken by the 4th respondent.

3. Though time was granted to the learned Government Pleader for Revenue to get instructions, no instructions are forthcoming.

4. Hence, the Writ Petition is disposed of, directing the 4th

respondent to comply with the directions of the District Collector dated 30.04.2015 and pass appropriate orders regarding correction of entries in the pahanies as sought for by the petitioner, within six weeks from the date of receipt of a copy of this order.

5. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
